Welcome to Amaya Events. These Terms and Conditions govern your use of our services, including but not limited to the purchase, delivery, and setup of balloon decorations, products, and other related services. By placing an order with us, you agree to these Terms.
1. Orders and Payment
1.1 Placing Orders: All orders must be placed by phone, or on Instagram DM. Orders are confirmed only after payment has been received and processed.
1.2 Payment Terms: 50% of payment is required at the time of placing an order unless otherwise agreed. We accept bank transfers only.
1.3 Custom Orders: For custom balloon arrangements or large orders, a non-refundable deposit of 50% is required at the time of booking. The remaining balance is due 24 hours before the event.
2. Cancellation and Refund Policy
2.1 Cancellations: Orders can be canceled up to 5 days before the delivery date for a full refund, minus any non-refundable deposits. Cancellations made within 5 days of the delivery date will not be eligible for a refund.
2.2 Refunds: Refunds are issued only in accordance with our cancellation policy. No refunds will be provided for completed Services or for orders canceled on the day of delivery.
2.3 Changes to Orders: Any changes to orders must be communicated to us at least 5 days before the delivery date. We will do our best to accommodate changes, but we cannot guarantee availability.
3. Delivery and Setup
3.1 Delivery Area: We offer delivery to local areas. Delivery outside this area may be subject to additional charges.
3.2 Delivery Times: Delivery times are estimated and not guaranteed. We will make every effort to deliver your order on time, but we are not responsible for delays caused by traffic, weather, or other unforeseen circumstances.
3.3 Setup: Setup is included in the price for certain Services (e.g., balloon arches, installations). Please ensure that the venue is accessible at the agreed-upon time. Any delays caused by the customer may result in additional charges.
4. Product Care and Liability
4.1 Product Care: Balloons are fragile products and should be handled with care. We are not responsible for any damage to balloons after they have been delivered and set up.
4.2 Outdoor Use: Balloons used for outdoor events are subject to environmental factors such as wind, rain, and extreme temperatures. We are not responsible for the longevity or condition of balloons used outdoors.
4.3 Liability: Our liability is limited to the value of the order. We are not responsible for any indirect, incidental, or consequential damages arising from the use of our products or Services.
5. Event Permits and Permissions
5.1 Permits: It is the responsibility of the customer to obtain any necessary permits or permissions required for balloon installations at the event venue.
5.2 Venue Regulations: The customer must inform us of any venue-specific regulations or restrictions that may impact the setup or use of our products.
6. Intellectual Property
6.1 Ownership: All designs, images, and intellectual property associated with our Services are the exclusive property of Amaya Events. Unauthorized use or reproduction is prohibited.
6.2 Photography: We reserve the right to photograph our balloon installations for promotional purposes. If you do not wish for your event to be photographed, please inform us in writing before the event.
7. Force Majeure
7.1 Force Majeure: We are not liable for any failure to perform our obligations under these Terms due to events beyond our control, including but not limited to natural disasters, strikes, or governmental restrictions.
8. Amendments
8.1 Changes to Terms: We reserve the right to amend these Terms at any time. Changes will be posted on our website and will take effect immediately upon posting. It is your responsibility to review these Terms periodically.
9. GDPR Compliance
9.1 Personal Data: We collect and process personal data in accordance with the General Data Protection Regulation (GDPR) and any other applicable data protection laws. The personal data we collect may include your name, contact details, payment information, and any other information necessary to fulfill your order and provide our Services.
9.2 Data Usage: The personal data we collect is used solely for the purposes of processing orders, delivering Services, and maintaining customer relationships. We do not sell, trade, or otherwise transfer your personal information to third parties without your consent, except as required by law or to trusted third parties who assist us in operating our business (e.g., payment processors, delivery services).
